This is the official E-mail from WBAI Local Elections Supervisor Dale Ratner about the extension of the election period for WBAI.

Note: as of the posting of this Web page there is a temporary restraining order against some of what the 2 Elections Supervisors propose to do. There will be a hearing in Part 23 of the Supreme Court of the State of New York, in and for the County of New York, located at 80 Centre St., New York, New York, (Room 320 thereof) on November 29th, 2007 at 10:30 AM. Dear Candidates, Board Members, and Staff,

Below is Casey Peters official ruling for the extension of the WBAI election. If people still need replacement ballots mailed to them, they must give me their name(s) and addresses by Monday, November 19th at 12 PM EST. E-mail is preferred and easier.

I will be at the station on Friday, November 23rd from 3 PM to 7 PM to collect ballots. I am still at the station until midnight tonight.

Regarding the WBAI Election Close Date

The Pacifica Bylaws timeline for the 2007 elections provide for 31 days from the mailing of ballots until the Election Close Date. Ballots for the WBAI election were mailed 8 days late. Therefore, the Close Date is also moved back 8 days, from November 15 to November 23, 2007. The vote count will commence the following day, with determination of quorum. If a further extension is then required, it will be set as near as logistically possible to the timeline structure provided in the Bylaws.

The earlier ruling regarding improper content in a private slate mailer shall stall except for the change of date for playing correctional announcements from November 16 to November 23, 2007.

Reports of failure to provide replacement ballots in a timely manner, of problems with mailing lists, and of the possible diversion of returned ballots to a wrong address will be taken into consideration in any future decisions on the timing and circumstances for the WBAI vote count.

Extension of the KPFK Election Close Date does not stand as a precedent for the WBAI situation as that adjustment was made in response to a resolution passed by the Pacifica National Board.
