CALIFORNIA ATTORNEY GENERAL BILL LOCKYER GRANTS LISTENERS STANDING TO SUE PACIFICA FOUNDATION DIRECTORS.

At 5 o'clock today (September 14th) California Attorney General Bill Lockyer granted Pacifica station listener-sponsors “Relator” status to sue Pacifica Foundation and its officers and directors, on behalf of the public interest, for breach of charitable trust, damages, removal of directors, bylaws revisions, and other claims.

The letter from the Attorney General's office FAXed to the listeners' attorney, Daniel Robert Bartley, said: “The allegations set forth by Relators raise substantial questions of law or fact regarding whether there is compliance with the purpose of the Pacifica Foundation charitable trust, whether its articles of incorporation are being adhered to, whether its assets are being properly protected, and whether it is being managed and directed in a manner consistent with the requirements of the California Corporations Code. The answers to these questions require judicial resolution.”

The “Relators” will file their suit in Alameda County Court and serve the directors as soon as possible.

The listener-sponsors who will bring the suit as “Relators” are Carol Spooner, Barbara MacQuiddy and Amburn R. Hague for KPFA (Berkeley) listeners, Charles P.H. Scurich and Ronald Swart for KPFK listeners (Los Angeles) listeners, Rick Pothoff and Kurt Guerdrum for KPFT listeners (Houston), Patricia Heffley, Carolyn M. Birden and John D. Biello for WBAI listeners (New York), and Arturo Griffiths and Leigh Hauter for WPFW listeners (Washington D.C.).
